Traffic Violation Options

The Clinton County District Attorney has added new options for motorists charged with certain non-serious traffic violations to resolve their matter. 

In addition to the options below, you may pled "Guilty" or "Not Guilty"  directly through the  court system.

Traffic Diversion Program  

 

Upon the successful completion of the Traffic Diversion Program, the motorist’s traffic ticket will be dismissed.

The following offenses are NOT ELIGIBLE for the Traffic Diversion Program:

VTL§ 319 (1)  
VTL§ 511 –any  
VTL§ 600 (1) OR (2) VTL§ 1144  
VTL§ 1174  
VTL§ 1180 C  
VTL§ 1180 F  
VTL§1192 - any  
VTL§1212  
VTL§ 1225 D

Child Restraint/Child Seatbelt Offenses

If you have a CDL license and were Operating a Commercial MV you are NOT ELIGIBLE to participate in the Traffic Diversion Program

NOTICE PURSUANT TO PENAL LAW § 210.45 IN A WRITTEN INSTRUMENT, ANY PERSON WHO KNOWINGLY MAKES A FALSE STATEMENT THAT SUCH PERSON DOES NOT BELIEVE TO BE TRUE HAS COMMITTED A CRIME UNDER THE LAWS OF THE STATE OF NEW YORK PUNISHABLE AS A CLASS "A" MISDEMEANOR.

Traffic Reduction Program  
 

The following offenses are NOT ELIGIBLE for the Traffic Reduction Program:

VTL§ 319 (1) (No insurance in effect at the time of offense)  Please note that if you had insurance in effect at the time of the stop but didn't have the proof of insurance at that time, you are eligible for the Reduction Program.  Insurance cards will NOT be accepted as proof of insurance.  You will need a letter from your insurance agent stating that you had valid insurance.

Child Restraint/Child Seatbelt Offenses

I hereby understand that by applying for and submitting a request to the Clinton County Traffic Reduction Program, I am waiving my right and or my client’s right to a speedy trial, pursuant to Article 30 of the Criminal Procedure Law and that I will not receive any further discovery to which I am entitled pursuant to Article 245 of the Criminal Procedure Law.

Aggravated Unlicensed Operator/Uninsured Motorist Program

Upon the successful completion of the AUO Motorist Program, the motorist’s ticket will be dismissed.

ONLY the following offenses are ELIGIBLE for the AUO Motorist Program:

VTL§ 319 (1) (No insurance in effect at the time of offense)  
VTL§ 511 -1 (a)  or  VTL§511 -2 (a) (iv)

If you have a CDL license and were Operating a Commercial MV you are NOT ELIGIBLE to participate in the AUO Motorist Program. This program requires the motorist to complete an approved traffic safety course AND provide proof of insurance and or proof of the clearing of the underlying matters that caused their license to be suspended in the first place. PROOF MUST BE PROVIDED AT THE TIME OF APPLICATION
